Certificates
of Non-Default Not Available after June 30, 2007
Effective July
1, 2007, the Commission will no longer be issuing Certificates of
Non-default. Section 81 of The Securities Act, 1988 will be
repealed on July 1. Subsection 81(1) provided that persons and
companies could apply for and rely on a certificate as to whether
a reporting issuer was in default of any requirement of the Act.
New section
80.21 will come into force on July 1, 2007. Section 80.21
provides that the Commission may publish a list of defaulting
reporting issuers.
The Commission
publishes a list of defaulting reporting issuers in its
Reporting
Issuer Search. The Reporting Issuer Search provides
information about reporting issuers and whether they are in
default of continuous requirements.
Part 4 of
Local
Policy 51-601 Reporting Issuers in Default sets
out information on how to use that Search.
